Let's start with the fact that the use of other people's photos is punishable by law. Article 1259 of the Civil Code of the Russian Federation states, “photographic works are subject to copyright”.

Let's do a little bit of fun and explain in more detail. In accordance with Articles 1268, 1270, 1229 of the Civil Code of the Russian Federation, the author has the exclusive right to use the work. And according to article 1229 of the same code, the copyright holder has the right to allow or prohibit other persons to use the result of their intellectual activity. Moreover, the absence of a ban is not considered a permit.

It turns out that if you took a photo without permission and indicated the name of the author, it is still considered a violation of copyright.

The punishment is serious - according to article 146 of the Criminal Code of the Russian Federation "Violation of copyright and related rights", a fine of up to 500,000 rubles or imprisonment for up to 6 years is imposed.

Therefore, before publishing someone else's photo, be sure to ask the author's permission. A simple message to Direct with his consent is enough.

But even if you accidentally break the law, you won't be fined right away. First, you should be sent a pre-trial claim. However, after that you will have to remove someone else's content in order not to get a claim for violation.

Instagram, on the other hand, can strip you of your account for “stealing” without any warning. But we note that the social network itself will not seek out plagiarism. Usually, the authors of the images themselves, or the users offended by you, complain about violations.
